Legal Question in Family Law in Wyoming

Common Law Divorce?

I reside temporarily in Budapest (a year so far) and would like to marry a Hungarian woman I love and return to the U.S. I have to submit a ''Free to Marry'' form but am in a quandary. My ''wife'' and I were married in Wyoming and separated in '94 in Grand Rapids, MI, and she moved in with her daughter in Flint. Her daughter said she next moved to Reno, a month later, to live with a man in a residential hotel. I cannot divorce her because I cannot find her, through the Internet or any other means. Her daughter is my only contact and she has no info on her whereabouts. My wife has my mother's and brother's contact info but has never used it. There are no custody or property/financial issues. Neither of us were interested in reuniting. How do I get free?

Re: Common Law Divorce?

To Whom It May Concern:

This is in response to your email of September 18, 2001, which this office received on November 5, 2001.

First, you have to file for divorce in the county in which you reside. Second, you have to file a motion with the court for alternate service of your wife. This may include mailing the complaint for divorce to her last known address or a publication in the local newspaper. Once this is accomplished your divorce will proceed like any other divorce. The final order that grants your divorce will be called a Default Judgment of Divorce, and it will simply state the property each of you will retain.

If you would like to further discuss this matter, please feel free to call.

Sincerely,

Michael D. Eberth
