Legal Question in Civil Rights Law in India

We are two brothers

My father died on feb 2014

He has not made any will..

So now the house is of three people my mother, my brother and mines..

But they are. Not giving me my share..

Also she has some fixed deposits which belonged to my father..

What to do now to get my share??

Is there any way?

Will i get money from the fixed deposits also if i file partition suit???

Please clearly explain..
