Legal Question in Family Law in India

My name is Arvind Kumar Gupta, I am the father of Priyanka Gupta who was married to Rangumbheer Singh Rajawat as per the hindu traditions in Roorkee - Uttarakhand on 4th October 2009, which was successfully registered later in Roorkee Court on 7th Oct 2009, before marriage my son in law promised that he will take my daughter to Canada and if in any case it is not possible to take her to Canada, he will come and settled in India forever with my daughter, as his work permit was about to get expired on 31 July 2010. But unfortunately, he did not take my daughter to Canada, over and above we were surprised to know later when he extended his Canada work permit for next 2 years.

It has been more than 4 years now he is residing in Canada only. Hardly 15 days he has spent with my daughter after marriage.

After the marriage his family changed suddenly and started dowry demand, for example his mother used to ask 10 to 20 lakhs Rs. for making a new house, his father used to ask 2 - 5 lakhs Rs. for elections and he himself used to ask money from my daughter many time and used to fight and abuse her.

He is earning approx 3000 CAD in Canada. But he never sends money for my daughter, so she is fully dependent on me. I doubt that he is married to someone else. There are cases pending in the court against him and his parents, under Sec 125 and 156. Hon'ble Court keep sending notices to Canada and in Rajasthan at his native place to intimate him and his parents to present on the prescribed dates, but none of them present till now on any date in the court.

Fera Kanoon should also be applied on Rangumbheer Singh Rajawat, because he has got a NRO a/c to transfer foreign money but despite that he transfers foreign money in another way that is illegal. He let my daughter to resign her Job, where she was earning Rs. 3 lakh annually. Now we are totally helpless to locate him in Canada, hence, it is my humble request that a strict action should be taken against Rangumbheer Singh Rajawat and his parents, so that my daughter can get justice.

Your faithfully

Arvind Kumar
