Legal Question in Elder Law in Alabama

My brother hasfull POA...I take care of my parents full time...they are not ready for nursing home yet...can I challenge POA to prevent him from placing them in a nursing home at this time?

I'm surprised that you do not have the benefit of being POA if you are caring for them and need to help with decisions. One certainly cannot place someone else in a nursing home if they are competent and not willing to go and the question of the powers of the attorney-in-fact. Then of course there is the way to pay about $8,500 plus per month for the two of them in skilled care. You need to see an attorney to look at potential long term care issues and possibly the issue of the POA straightened out.
