custody of grandchild

How hard is it to gain custody of your 2 year old granddaughter whom we have raised since she was 2 weeks old, and that has lived in our household without either parent? they have never supported her but yet they claim her on income tax. they have not been mommy and daddy to her, the father doesnt hold a job very long at the time and stays in trouble with the law, and parents are now separted for the 2 time.

in order to gain custody, the person desiring the custody must basically prove to the court that the best interests of the child would be for them to gain custody. in other words it would be in the best interest of the child for the child to live permanently with them. there are many factors that a court may use to make this determination. there are also many other legal issues that may be considered by the court in making this determination. you need to consult an attorney to be fully advised.
