the answer and waiver can be filed with the complaint, or after filing the complaint. after the comlaint is filed there is a period of time allowed for service of the complaint. after service of the complaint on the other party the case will be set for trial by the court. if a settlement is reached during the time before service or during the time between service and the trial setting, the waiver and agreement and certain other necessary documents may be filed. The case will not be set for trial unless service is obtained against the other party.
