Family Business

If you have a family business and you get a divorce, what happens to the business? The business was started during the marriage of 23 years and now my husband wants to bring a partner on with just his name and the partner's name and leave me out.

The divorce should have resolved ownership of the family business. If there is no mention in the divorce as to who gets what or any shares, then it would belong to person or persons names listed on the business (corporation or sole proprietorship). If there is only one person on those documents, it would belong to that person to do as that one wishes. If no mention is made of who owns the business and in the past both have been involved in the business, then I suppose it is up in the air for a civil lawsuit.
