If a mother has been told by a court order to change a childs last name due to a court ordered paternity test in which the said father was not the biological father and it has been 5 years since the court order and the child still has the said fathers last name what can be done legally?

You can change the last name anytime you want to. However, the Court does not have the power to order you to change the child's last name. There is no statute that provides that with the exception of with a good cause.
