Legal Question in Family Law in Alabama

Sending injured wife to another state without her permission

My husband walked out on me, stating he wanted a divorce, purchased a house and car and never filed any divorce paperwork. Do I have any rights?

2) After being dismissed from the hospital with head injuries, my husband set my dogs free and took the cats with him, any laws against that?

3) My husband sent me with my parents to recooperate. I had no knowledge of this venture, I was transported across state lines, and he doesn't want me to return. Any laws against that?

4) He has not filed any divorce paperwork, we have been separated for five months, shouldn't I receive support from him?

Re: Sending injured wife to another state without her permission

Well, ma'am, I'm sorry to hear about your predicament. Yes, since you are not divorced, you do have an interest in the marital property-including the house and car. Placing you with your parents to recuperate is not inherently unreasonable, however, if he had knowledge that this was not what you wanted, it is certainly improper. As for the dogs and cats, pets are considered property and he could be liable for damages if the dogs cannot be located. I would suggest contacting an attorney directly regarding these matters. Separation and divorce can complicated, depending on the factors, and parties who are unrepresented in a divorce proceeding can be railroaded quite easily.
