Legal Question in Employment Law in Alabama

communication failure

My employer has started giving my work assignments to someone else and will not discuss this with me. I have recieved no explanation for this action and, now, I am not making enough money to pay my bills. What can I do?

Re: communication failure

If your employer is not paying you minimum wage ($5.15/hour) and you are otherwise non-exempt, you have a cause of action under the Fair Labor Standards Act. Also if you are not being paid for hours worked at all then there is a problem - unless of course you are being paid on a commission basis as a salesman.

However as to the specifics of your question, you cannot compel your employer to give you work - unless there is a problem with race or sex discrimination. If that is the case, then there is a serious problem for which you will undoubtedly need legal representation.

There may be a few other avenues but I would not be able to help you without more information. Please call me at 458-1100 and I would be happy to discuss this situation with you.

Sincerely,
