Wrongful Death

Our daughter was killed in a one car accident in 1995. She was drunk. Left behind two children. Husband filed wrongful death suit againt establishment that served her alcohol. Suit was settled and both kids are to receive money at age 18. Her husband is now broke and we fear that once they turn 18, he'll take their money. It's supposed to be used for college. Is there any way to protect their money even after they turn 18?

The age is 19, not 18 in Alabama. A lot depends on the amount of the settlement as well as the way it was structured. Is there a conservatorship set up, or was the money structured? Any funds will be paid directly to the children unless there is some sort of trust or other type of structure. Once the 19 year old receives the money, it is their decision as to what to do with it so if they pay it to the father voluntarily, there is nothing you can do about that.
