Legal Question in Wills and Trusts in Alabama

will

my husband just died in another state from me 2 kids together do i need to obtain a lawyer to find out if there is a will or estate or are we automatically going to get what is owed to us also he owed back child support

To give you a more specific answer, a lawyer would need more information. Where were you and the kids legal residents at the time of his death? Where was he a legal resident? Were you divorced or merely separated? If separated, were you separated under action of some court somewhere by decree? Was there an existing order requiring child support? How did your husband die? Would you be entitled to sue on his behalf as his spouse? Are you entitled to any retirement benefits from his employer? Etc etc.

Short answher- consult with an attorney to understand your rights. These bulletin boards are great for some questions but yours would require more than this site can provide. Call your local bar association and explain your situation. They can refer you to a local attorney. If you are still living in Utah, call the Alabama Bar Association for a referral. Either you or someone else (through an attorney) can open probate to see if there is a will and what debts and assets are owed. If you do nothing, chances are you will get nothing. You may call for a free consultation.
