Legal Question in Bankruptcy in Arizona

The laws on bankruptcy descrimination

Hi,I want to know what my rights are against bankruptcy descrimination. Here is my situation:I filed ch. 7 bankruptcy about a year ago and I moved to CA and have been living in the same apt complex for just about a year. I moved in there when my best friend was living there and she moved and I was in the process of signing a new lease w/a new roommate. The manager told us that he would have to run a credit check again and requalify us and when he did he told me I have 2 mo to move out or he'll evict us because my bankruptcy hadn't shown up b4 on the credit check but it did now and it is their policy not to rent to people that filed bankruptcy in the last 2 years. So even though I've been there a year and always pay my rent on time he's kicking me out solely because I had filed bankruptcy-is this legal? What are my rights?

Re: The laws on bankruptcy descrimination

There is nothing in the bankruptcy code preventing a private party from using bankruptcy as a basis for denying credit. It sounds to me like your question should be submitted to a landlord/tenant attorney; it doesn't sound like a bankruptcy issue to me.
