Legal Question in Family Law in Arizona

My son has been divorced for two years and has a three year old daughter with his ex wife. Currently he is paying approximately $630.00 in child support. His ex wife works part time but starting in January she plans on not working and going to school full time. She is asking my son to pay an additional $125.00 a month so that their daughter can go to a private preschool. Is it true that he could end up paying more child support after January if she goes to school full time and does not work? I thought both spouses are responsible for the well being of their children.

I would need to know more. He can argue that her choice to go to school is not in the child's best interests and that the private preschool is unnecessary or extraordinary.

I realize this response is very delayed. I had been out of the LAWGURU response mode for awhile.

However, if you still desire such, we can certainly help you consider and then pursue your options. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
