Legal Question in Landlord & Tenant Law in Arizona

Security Deposit

I turned in all keys to an apt on 6/4/09 asked abt my security deposit was told I would receive it in abt 2 to 3 weeks. I put down a $450 dep,$100 of that was non refundable after getting the runaround I received a check on 7/17 for $150. On a piece of paper they have written, maintenance had to move headboard, microwave(which they kept) and had to clean carpet. When I turned in my keys I let the property manager know I was leaving those two things and she said ok,but asked if the apt was clean,I told her ,yes. Can they do this? Do I have any recourse?

Re: Security Deposit

They can deduct for damages and cleaning if reasonable. However, they must return your deposit within fourteen days. Failure to do so makes them liable for damages. You should contact an attorney to help you. Some firms, such as mine, may take this matter on a contingency fee basis. That means you pay only costs unless you collect.
