Sue the person directly.

Re: automobile accident

Your best option may not be to sue the person directly. Many people who have no insurance are judgment proof, and there are court costs associated with getting a judgment, perfecting it, garnishments, etc. and they are tricky procedures which raise liability for you if not done properly.

See an accident attorney. You are probably limiting your recovery and rights by not doing so.

There may be medical pay claims, uninsured motorist claims, or other means of settling your case. The driver may have other coverage, or be covered by a household policy on another vehicle. All facts are not presented here to give a proper opinion.
