Legal Question in Real Estate Law in Arizona

Property Value Loss

I live in Arizona next to an Indian Reservation. The Indian Reservation wants to build a detention center close to my house. The Reservation is a sovereign nation and they can do just about whatever they want, but this detention center will most likely be built by an outside engineering firm, could my neigborhood sue the engineering firm for property value losses? Is there anything we could do?

Re: Property Value Loss

You are right, tribal land is a sovereign nation and they can build a prison anywhere on their land that they choose to do so. No, you and your neighbors do not have a claim against the engineering firm, nor do I believe that you have a good claim against the tribe.

You could and should act like a good neighbor and carefully approach the tribe in a manner respecting their customs and culture, to express your concerns and the potential affect on your neighborhood, and ask them to consider the placement and character of the detention center in light of your concerns.
