The spouse has a right to his share of the community property. The spouse has no right TO inherit the deceased spouse's separate property or community property share, unless it is specified in a valid Will. Any person is allowed to leave their property to whoever they want by Will. IF THERE IS NO WILL, then state law will control, and then the surviving spouse will receive a share, and could receive all.
