Legal Question in Wills and Trusts in Arizona

was in the will/not sure if uncle died or not

I am the niece that was in my uncles will at one time. I am not even sure if he as passed away. I lost touch with him sometime ago. I do believe his second wife if still alive, not sure. How can I find out if the will was filed or not?

Wills are not "filed" with the court unless a probate is opened. Not all estates require probate, since many people place assets in joint tenancy, Pay on Death, or beneficiary status so that the assets go automatically to someone. More thoughtful estate plans use trusts, which do not go through probate.

If the will was admitted to probate, you can search the Maricopa County Superior Court website. Here is where you look: http://www.superiorcourt.maricopa.gov/docket/probate/caseSearch.asp
