Do I have a chance?

He told me he was married after I got pregnant. We were together for a while after the baby was born. Since then we split, and I got married to someone else. He wants to move out of state and take my daughter with or without my permission. He has been in prison a couple of times years ago. Do I have a chance of winning custody. Also we are stable but cant really afford legal representation. What should we do about that?
