Legal Question in Employment Law in Arkansas

Employment question

I work full time for a company that owns multiply companies in Little Rock, AR. I had inquired with my current employer about working part time within one of our other companies. All companies file under separate W2 and tax ID numbers/names. I was told by my current employer I could not work for work for the other company on a part time basis b/c of over time issues. I have been told by others that overtime should not be an issue b/c of the filing status of the companies. Which is true?

Re: Employment question

If there is common ownership, then there is a real risk of the Department of Labor determining that these are really a single employer. This means that any hours you work in excess of 40 during a single workweek would have to be paid at time and one half.
