Legal Question in Family Law in California

My boyfriend has a 8 month old who he has custody of at the moment due to the mothers drug issues. Can the mother request a court order to have me stay away from the baby, at the moment im not allowed around the baby because she supposedly asked for this at their last court hearing. The weird thing is that my bf was not made aware of this in court and was just recently told by the social worker that it was court ordered that i can be aroung the baby. Doesnt she need proof that Im Violent or harmful to be around the baby? The only reason she does not want me around the baby is because my bf left her and then started dating me, there are no other reasons.

She can ask for an order keeping you away from the baby. Whether or not the order will be granted is the question. You have provided no information about yourself and the reason she gave for asking for the order. The pertinent information about you would be criminal history, how long you and your boyfriend have been together. You should contact an attorney or the local family law legal clinic for help in regard to opposing the requested order. Trying to get an answer over the internet will not be possible.
