Legal Question in Disability Law in California

disability discrimination

I am an ADA case and, because of intermittent leave, I am asked to do daily status reports in case I am out the next day and mgmt needs to know where I left off. Nobody else is asked to do this daily status. Mgmt said their legal dept gave them green light, that ther request was reasonable. I work in MIS for huge firm and nothing really has a mission-critical deadline that cannot wait. On a related matter, I am constantly being told that I cannot work on certain projects because of my intermittent leave. Any legal issues here?

Re: disability discrimination

A company has to make 'reasonable' accommodations for a disabled person, but so must the person make 'reasonable' accommodation to the job requirement and business needs of the company. You have to be able to do all the substantive aspects of the job in a way that satisfies the needs of the job and the company. Disability law does not give you a free ride or a guaranteed job, only the right to work if you can do the work with 'reasonable' accommodation. There is no easy answer to whether they are violating the rules. If you think they are doing so in a serious and provable way, then feel free to contact me to discuss the evidence.
