Legal Question in Business Law in California

Hired a contracter to draw plans for a garage convertion. we gave him a deposit and signed the contract. when he finished the plans the total cost was more than we could afford. we told him we did not have the money at he moment. after along period of time telling him we didnt have the money, he convinced my husband to write him a check for an amount less than the total and an amount that we didnt even have funds for. he didnt give us the plans so my husband put a hold on the check. he called demanding a payment and threataning to put my husband in jail if he didnt recieve payment. i told him we dont have the money he can keep the deposit and keep the plans. can he sue us?

Well there are several issues. If you contracted with him to do construction he need to do what was provided for under the contract. If he does not then you may be able to contract with someone else and if it costs you more you may be able to sue him under the rule of cover.
