Legal Question in Civil Rights Law in California

Lawsuit time limits

How long would one have to commence a lawsuit against the police department after being found not guilty for any of the charges. Reason being because at the time I had no money to continue any legal action, and now I do. Is there a time frame?

Re: Lawsuit time limits

Of course there is a statute of limitations / time frame. Typically 6 months to file a claim against any government agency. However, just because you were 'found not guilty' does not mean you have grounds for suit. In fact, probably quite the opposite. That the case wasn't dismissed before any prosecution commenced indicates there was sufficient probable cause to convince both the police and the prosecutor. Sorry, but to have a valid claim against the police requires proof that they willfully did something outside the scope of their authority and without any proper basis. Just because the prosecutor couldn't prove his case to the jury doesn't mean you were 'wrongfully charged'.
