Legal Question in Civil Rights Law in California

Statute of limitations on a Civil child molestation case in California?

A family member of mine was interested in pursuing a Civil case against a person who molested her child. She lives in California and would like to know what the statute of limitations is for this type of case.

Re: Statute of limitations on a Civil child molestation case in California?

The statute regarding child molestation is very broad. It depends on either the victim's age, or the date when the memory was "recovered." In this case, I am assuming the victim is still a minor. Therefore, the lawsuit must be filed within eight years after the child attains the age of majority (18th birthday plus eight years).

Whether or not there is a case, is a whole other question. If you would like some advice on that subject, feel free to contact me.
