Legal Question in Technology Law in California

I paid an online company to help me set up a business. (2008) To date, they have done almost nothing except use my money. I do not have a logo, business cards, or web page that was promised. When I try to contact someone I MAY get an email response that they are working on it. Then nothing else. The last contact I had with a human, I was told he'd look into it and I should call him back. When I called back it went to voice mail that was never returned. Do you think I have a legal method to force them to return my money?

Depending upon your having a contract of sorts for the services, and proof of payment, and also that the company is still in business and has any money, you'd probably have a winnable case, at least in theory. Unless the amount you spent was very significant and you are quite lucky, I'd guess that you are going to spend more (in money and the money value of your time) in the suit and collection process than you're likely to recover. The online company is probably in a different part of the state, or a different state, or maybe overseas. They would be hard to serve and hard to collect against.
