Legal Question in Construction Law in California

My mom had hired her friends husband who claims to be a contractor in order to replace and install a new kitchen sink. This person had performed the job 1.5 years ago but now the new plumbing work under the sink is leaking continuous amount of water and the sink had become clogged. I want to know if we can sue the contractor (im uncertain if he is licensed and he also did not secure a plumbing permit from the city claiming that he doesnt need it because the work is easy) in small claims court for the amount of the labor he had charged back then IF the certified inspector I have called today determines that the work he had done IS faulty. Can we sue him more than the labor?

If he's not licensed for the work he did, you are entitled to a 100% refund, plus the cost of having the work corrected. Unlicensed contractors cannot keep any of the money they are paid for unlicensed work, and they are liable for any damage they do.
