Legal Question in Construction Law in California

Obtaining documents from contractor

I hired a contractor to build my house.

I believe he has misled me as to where my money has been spent since he cannot and refuses to account for at least $40K.

Is there any process whereby I can have him legally forced to produce receipts and other documentation showing where the money was spent? A court order for example?

You don't indicate whether the contract is "fixed price" or "cost plus" or "time and material" or what. Further, you don't indicate whether the contractor has completed the project, is still working on it, or has abandoned the work. All of these factors meed to be known in order to provide a reasoned response. I recommend that you talk to a local attorney who knows construction law.

Sure, you get a court order after you sue him and propound discovery to him that he refuses.

You should have a local attorney review the contract. If it was a lump sum contract, you aren't necessarily entitled to an accounting.
