Legal Question in Consumer Law in California

5 months ago I bought and paid for a sofa. No delivery time was given. I expected to wait 2-3 months for delivery. The dealer said there were problems getting the fabric. Now they still cannot give me a delivery date. What is a reasonable time to wait, and can I rescind the order and have my money returned?

5 months sounds like more than a reasonable time to wait. Write the dealer that he has ten business days to deliver or you will consider him in breach of the contract and he must return all of your money. Your problem is that you must be diplomatic with the dealer as if he says no then your only option is to sue him in Small Claims Court and try to collect.
