Legal Question in Consumer Law in California

Billed unfairly

Recently my cell phone company sent me a few very costly items that I DID NOT ORDER. They acknowledge that I customer service called to advise them of reciept of the items and requested return shipping lablels be sent to me for their return. I requested that the items be removed from my bill, they refused, stating that they would be removed from my biil when their warehouse confirms reciept of the items. It has been 2 months and they are still on my bill, and the cell company denies ever recieving them therefor they are forcing me to pay this totally outragous bill to avoid interuption of my service and collections actions. If service is interupted, they will apply a $36.00 service fee per line to reactivate them, I have 10 lines so this is not an option! Can they do this?

Re: Billed unfairly

You need to read your contract with them. It should talk about this issue.

The big question is how did you send them back? Is there a way to track them? If you sent them back, you should be able to track them and show receipt. If you can show receipt, you can give it to them. If they were lost and you can prove that, file a claim with the shipping company. If you did not send them through a method that can be tracked, you may get stuck on this.
