Legal Question in Consumer Law in California

consumer law

was sold a used BMW from Crevier BMW and discovered that the back middle seatbelt was missing the buckle (part you snap the belt into). Is there anything I can do? Can they legally sell a car that does not have all the safety restraints? I discovered it only after I had 3 small minor children that I had to transport (too young to sit in the front seat) so I was stranded and had to call for someone else to come and get the kids.

Re: consumer law

I suggest you contact them and inform them of this missing part and ask them when you can bring it by to have it repaired.

I suspect cars must be sold with working seatbelts and the dealer may be inviolvation of state and/or federal law.

I also suspect it was not disclosed to you and therefore you have a claim for misrepresentation. Take another look at the contract.

Before resorting to legal claims, however, I would call the manager and explain what happened. They should be willing to fix it on their dime.
