If the recording is in a situation where the employee has a reasonable expectation of privacy, it is illegal. Monitoring of workplace computer and internet use is almost universal, and employers often monitor and/or record customer-facing telephone lines, but you would be informed of either of these. Obviously illegal conduct could include cameras in rest rooms or locker rooms, or the surreptitious placement of microphones in your cubicle. If you believe illegal recording or monitoring is taking place, see an employment lawyer in your locality. Do not keep notes or diaries at work, or on your work computer. Watch out for legal time limits.
