Legal Question in Consumer Law in California

Can They Really Do This?

Three weeks ago, I made an order with a company in CA for $221 (including COD charges). I told them I always order COD because I live in the ''ghetto'' and don't want packages to sit on my doorstep.

I have not received the package. When I inquired about it, they said it had been delivered and left on my backdoor. The company goofed and sent it out without the COD.

I spoke to a customer rep who said, ''Well, would you like to put this on your credit card?, We need payment today...'' It's like she didn't hear me when I said that I didn't get it!

Now I still don't have my order and they are turning me into a collection agency for $300.

Am I liable for someone elses mistake?

Thanks,

Re: Can They Really Do This?

No you are not. Tell them you said COD and it has not been received. If they notify any credit reporting agency, you will sue.
