An individual is served with a summons to appear in court regarding non payment of a debt in the amount of $7,540 unbenounced to the claimint who thinks her son opened the account in her name with out her knowleddge. What form is used to respond to the court and plaintiff

The individual needs to file and serve a responsive pleading within 30 days of service of the summons -- which might be an answer, demurrer, or motion to strike, or a combination of them. The answer can be found at http://www.courtinfo.ca.gov/forms/fillable/pldc010.pdf . The individual might want to discuss it with an attorney to see if she might have a statute of limitation or other defense(s). Also, the individual might file a cross-complaint against her son.
