Legal Question in Credit and Debt Law in California

Liability For interest on an overdue bill

I have received a demand from a debt collection agency with respect to a medical bill that is about 2 years old. As I never received the original bill (infact the copy of the orginal invoive shows an incomplete address), I do not see why I should have to pay the interest that they are demanding. What are my rights here? - Do I have to pay the interest?

Not unless your original contract with the creditor calls for interest.

You have a right under the fair debt collection practices act to contest the validity of the bill and the interest. If you signed paperwork then you have a written contract which may require you to pay interest. If you did not sign paperwork, then a court would probably find that you do not owe the interest, but still owe the bill under an implied contract theory. If the bill is big enough, you might consider filing bankruptcy.
