Legal Question in Criminal Law in California

653m pc

I am being charged with 653m pc, 422pc. This is a first offense. This is a result of a fight with a friend and I left harrassing messages on her phone. It was only one night of messages. She filed a restraining order which I was able to beat. What are the chances of getting these charges dropped.

The fact that a judge did not order the restraining order against you is good evidence that a qualified attorney can use to attempt to get the 422 pc charge dropped. The 422 is the most serious charge you face. A possible felony and strike. You really should talk to a qualified attorney and g o over the specifics of your case. The restraining order is looking at whether or not there was a need to have a court order against you to deter future conduct. For the criminal charges, they're looking at past conduct and deciding if you violated a criminal statute. Similar, but a slightly different analysis.

Get a lawyer for the criminal case. I assume the alleged victim gave testimony in the restraining order hearing that your attorney can use to your advantage - anything from getting the charges dropped to a better deal - it all depends on the facts as they come out.

Depends on whether you have actual defenses, facts, evidence, testimony, etc, to convince the prosecutor there was no basis for the charges being brought. You've already admitted in this posting to several grounds for the charges. Therefore, I suggest you hire counsel who knows how to properly defend and deal with these charges.
