Legal Question in Criminal Law in California

Evading police

I sold my truck years ago to a stranger and never turned in the paper work to DMV. Just the other day I was arrested for evading police in that truck but I have not seen it since I sold it. I was with my son and father all day. They came to me because they were unable to find the person who was really driving the truck. What can I do? I am facing a year in jail for a crime I did not commit.

You get an effective lawyer to defend you, that is all. If you cannot afford a private attorney, you will be entitled to services by a public defender. Looks like you have a defensible case and you should prevail.

Prove you sold the vehicle. Use paperwork, witnesses, etc. Since you were charged, and don't know what to do, get an attorney to represent you that does. IF the case is in SoCal courts, feel free to contact me for that help.

The legal answer to your question is obvious: you cannot legally be convicted of a crime you did not commit. Having said that, people get convicted of crimes they do not commit all the time. The law is not perfect. Do not talk to the police or anyone about this without a lawyer being present. True, you may be able to get out of the current charges, but the police will be investigating your background, and may dig up something else on you so you do not sue them for false arrest. So, proceed cautiously.
