Legal Question in Criminal Law in California

Felonies

How difficult is it to have two felonies

reduced an/or exsponged off ones'

record? They are from 8 years ago and

are non-violent.

Re: Felonies

Some felonies can be reduced to misdemeanors...some can't. Don't know what yours are. If probation is successfully completed they can be "expunged". This is a pre-requisite to a certificate of rehabilitation/governors pardon on felonies...if state prison was involved only the cert/pardon route is available and certain offenses are excluded from relief...i.e. sex crimes.

Re: Felonies

Your question was whether these convictions could be expunged. In California to have felonies expunged, you must generally get them reduced to misdemeanors first. Without starting at this step, it is not likely that you would be able to get these off your record.

I would like to talk to you about this more to see if you may qualify for this reduction and ultimately an expungement.

Re: Felonies

First, the felonies must be reducible by law. Some felonies are - so-called "wobblers" - and some aren't. If your offenses were wobblers you absolutely must reduce right away.

As far as expungement goes, if you received probationary sentences - not state prison - theoretically both felonies could be expunged. You might have tougher time with the first one since you did not keep your record clean after committing your first offense. If the second felony took place while you were on probation for your first one, that could also be a problem. All said however, you should try and you potentially could have both of them exunged.

Re: Felonies

It is possible if you were not sentenced to any prison time, and if you successfully completed all terms of probation, and if the felony is not one of the listed 'prohibited' types such as sex crimes. Feel free to contact me if serious about seeking expungement.
