petty theft

About a month ago I walked out of a local grocery store with less than a $100.00 of groceries..they did not stop me but got my license plate number and a few hours later the police came to my door. I denied not paying for the food, they said they have it on camera. but left without citing me. I just received a letter from the D.A. saying they are filing petty theft charges against me..should I plead guilty? It was a very dumb thing to do and I feel terrible for doing it. I am recently divorced, a full time student in hopes of getting my degree in nursing. what do I do? 15 years ago I got caught taking 2 items from a grocery store in northern Calif. and they expunged or sealed my record..What are my options..please help..Thank you

Your options are to plead guilty, or not guilty and fight it. The answer to your question doesn't help you in the slightest.

You need to understand that the expunged conviction is a prior for the purposes of this new charge. Unless you know how to effectively represent yourself against a prosecutor hired to put you in jail, you should hire an attorney who does. He may be able to keep you out of jail and negotiate a deal you can live with, or he can take it to trial if appropriate.

Your options are limited and they depend on what you want. First you need an attorney. So you need to determine if you can afford one. If you can not afford an attorney the court will appoint you a public defender. Second do not talk to anyone about the incident. No one at all except your attorney. Answering questions by the Police will not help change anything and they will use anything you say against you. If the police want to question you and you have not hired an attorney yet or you have not had a Public defender appointed yet, tell them you want an attorney at least for questioning purposes. A public defender will be appointed for questioning purposes. Start shopping attorneys. Ask your friends for referrals and if that does not help call the local county bar association and ask them for their referral list of criminal defense attorneys. If you have to pull out the telephone book and start calling attorneys and find out the financial arrangements that can be made. Finally, do yourself a favor and stop wasting time asking general questions on the internet and trying to look things up. The best thing you can do for yourself is to hire an attorney. Good luck
