Age Discrimination By Doctors

I am in the process of selecting a PCP (a gatekeeper) in my new HMO health insurance plan. I called a medical group and was told that the doctor acting as the PCP was not taking any patients older than 50. Is that legal in California?

Probably not, unless there's a sound medical reason such as the doctor doesn't know how to treat ailments that afflict people over 50. Perhaps you could find out why that is the case and pursue the matter.

Some doctors have arrangements with HMOs where they lose money if the patients require referrals to specialists. You could certainly make the argument that this is an unfair and unlawful business practice. Maybe you have a case.
