Legal Question in Discrimination Law in California

am i being discriminated by manager?

we have a new manager, and the same manager i was under with 4 years ago that assigned me 40 miles away from home is now my ''NEW'' manager again and since he became my new manager he is giving me a hard time again and changes my position - and giving me different assignment/task. i documented everything that had happened and he definitely has favoritism and only white employees gets to advance in him. i am asian and i expressed my concern to him already and to his manager. nothing has changed. am i being discriminated? i am not the only one that feels this way here at work.

Re: am i being discriminated by manager?

It may be discrimination, it may only be politics and personality. You say only white employees advance. You have to explain and prove the 'evil' motive behind his conduct to win a case. You would need to show some kind of specific comments, behavior or attitude that would indicate he doesn't treat Asians/you the same as whites and others. Depending on what you want to accomplish, you can get an attorney to represent you, from doing as little as demanding remedy of the situation, or take it all the way to filing suit if there are enough facts and witnesses to support a case. Feel free to contact me to discuss the facts and proof needed.

Check the employee handbook, if any, and see what the procedures are for reporting discrimination. Follow those steps to complain if you desire to pursue it. The company is obligated to make a reasonable investigation. If it doesn't it's violating the law.
