Legal Question in DUI Law in California

dui outcome

I do not know if my dui case was

dismissed. I was arrested in Santa

Clara CA on 4 July 2005. I assumed

the case was dismissed since I have

not received anything from the

courts. Now my insurance company

is going to raise my insurance unless

I can provide proof that it was

dismissed. How can I obtain a copy

of the outcome of my case?

I would go to court and ask for a print-out of any cases pending under your name. If there aren't any, great. Get a print-out showing that there are no cases pending.

You would know if it had been dismissed; you would have been in court and heard the judge say that, or you would have gotten a letter from the DA. Upon your arrest you were given a court appearance notice. You probably ignored it or failed to read it. Call the court and request they check your file. You probably have an arrest warrant outstanding, since the insurance company says you have a case on your record. To clear this up, you'll have to have an attorney local to the court represent you and appear with you.
