Legal Question in DUI Law in California

DUI Warrant

A friend was arrested and convicted of a DUI last Oct. He then left the country before serving his time and now there is a warrant out for his arrest. He is back in California and thinks that if he just dodges the law for the next 4 years, the statute of limitations will run out and they won't be able to arrest him. Is this true?

No, he needs to get the bench warrant cleared.

Re: DUI Warrant

Hell no; warrants are forever. So are the 'charges', once they're filed against him, until the case is finally closed. SOL's apply only where no charges get filed, as when the police don't know 'who dunnit'.

Tell him not to listen to the ignos in the bar about a 'run and hide' option. Gee, wouldn't that be wonderful for every criminal to make use of!

In his case, if he comes in contact with any police or security checks anywhere, he goes away in cuffs to jail and to court where he'll not like the reception he gets. Tell him to grow up and turn himself in to the court. Dealing with the problem voluntarily will result in a lot less pain than being brought in a jumpsuit and shackles.

If the case is in SoCAL, feel free to contact me if serious about getting counsel to help handle this and minimize the pain of the FTA, probation violation, and warrant.

Re: DUI Warrant

A bench warrant is like a old dog, it will always follow it's master.

Get it taken care of, or it will take care of whoever has the warrant.
