Can the office of D.A destroy my blood sample eventhough the charges against me are still pending?

I was involved in a DUI case which is still pending and I am fighting it.

I assume you mean the police destroyed or list your sample.

No, they cannot. Your attorney should be looking into a motion to dismiss the charges based on a Trombetta violation.
