Name Change for minor child

Can I change my 2 yr olds last name without contacting biological father? We have been divorced 1 yr, no contact, no money, (1 1/2yr abandonment). I have full legal and physical custody. I would like to change her last name to be my maiden last name (as I have gone back to my maiden last name). Do I need his consent? What if I have no clue where he is living?

You will have to file a petition for name change, the court will set a hearing to determine whether a name change is in the best interest of your child. The notice of the hearing date must be served on the bio father, and published in a newspaper for 4 weeks. The bio father or any other party can appear at the hearing and object. It is advisable that you hire an attorney to represent you. If you have any other questions we would be happy to assist you.
