Getting child back

I filed for divorce and he defaulted, I havent entered default as of yet, I let him talk our son for his grandmas funeral and he now says he's filed papers come get them, what can I file to get my son back before I see him and he servces me?

As Mr. Koury advised get a default judgement in your case. The default judgment should contain an order giving you full physical and legal custody. You should be able to get this order in one or two days if every thing is in order.

After you get the judgment with the custody order go to father and demand the child. If he refuses to give you the child then call the police. If that is unsuccessful contact the district attorney's office, in either the county in which you live or where father lives.

You should seriously consider hiring an attorney to assist you in getting your child back as quickly as possible.
