Legal Question in Family Law in California

My daughter's dad never signed the birth certificate and isn't in her life sense she was about 5 months. Now she's 13 months and has made little effort to be in her life. I needed some state assistant and they make you put child support on the father so I did. But he doesn't see her and only texts to cause problems not even asking about her. He showed up at 12:30am intoxicated demanding to see her. I told him no and he made a Sense and left. I'm wondering if he can sigh his rights away of we both agree on it?? What rights dose he have to her??

He has the same rights as any other father. If he comes to your home drunk call the police and request their assistance in dealing with them. You do not have to let him see her in the middle of the night. To see her he needs to come when she is awake. Contact and attorney for help, or the local family law clinic.

It's obvious from a situation that you described the father is immature and irresponsible. Get the appropriate restraining orders for contact between yourself and the biological father and for the benefit and safety of the child.
