Legal Question in Family Law in California

How do I get someone declared legally insane?

I was just wondering what conditions must be met for someone to be declared legally insane. Also, what legal rights/responsibilities do the family of that person have?

Re: How do I get someone declared legally insane?

Some of the procedure depends on the context. Basically, you file a petition in court outlining why you think this person is unable to care for himself/herself. If they present a danger to society, the court can take them into "custody" and put them in an institution for a limited period of time. If it's more a question of someone being old & unable to balance a checkbook, you can file for a conservatorship.

The family's responsibilty depends on the nature of the relationship. If it's a child, then the parents have an obligation to support the child. If the person is an adult, the state takes care of it--after using that person's assets first.

Good luck.
