Legal Question in Family Law in California

My Fight For Custody Against A ''Snitch'' For The Police

I am in a custody battle with my husband (whom I have been separated from due to Domestic Violence for over 4 and a half years) over my 9 year old daughter. My problem is that my husband was recently caught by the DEA manufacturing Methamphetamines in his apartment (where he lives with my daughter). He was put in jail over this, BUT, the DEA has not yet filed any charges against him. WHY? Because he's turned snitch and is going to help them bring some of his ''friends'' down. My problem is that in the county where our case is, he get's preferential treatment - not matter what he does! He's a twice convicted felon with a rap sheet as long as my arm. I have never been arrested. I've been fighting him for 4 and a half years. I've gone through many attorneys. NOW, I have no money left to fight with, I don't even have any strength left to go to court. In the meantime, my 9 year old angel lives with a man that has no food in the fridge, that takes her to the junk yard at 11 at night for hours on end, who takes her dumpster diving in odd neighborhoods at odd hours, whose drug friends come over and spend days at their apartment. HELP!!!!!!! I don't know where to turn. No one wants to take my case or help me, can you?

Re: My Fight For Custody Against A ''Snitch'' For The Police

This is a hard one to figure out. He's a felon facing felony charges. You're clean as the driven snow and he's got custody?

Making meth is dangerous work. Having the child around is endangerment. Have you called CPS? Have you had her checked by any "required reporter" like doctor, teacher, etc. so they could call CPS?

There's got to be more to this. If you have custody and he get's pref treatment in that county, move. But get court okay, first.

CALL DEPARTMENT OF CHILDREN'S SERVICES AND REPORT THE PROBLEM TO THEM. UPON AN INVESTIGATION THE CHILD WILL BE REMOVED FROM THE FATHER IF THE FACTS STATED HERE ARE IN FACT TRUE. FURTHER, UPON FILING A COMPLAINT BY THE COUNTY, THEN CHILD WILL BE TEMPORARY PLACED AT ANOTHER'S HOME AND/OR TO YOU AND MAY BE PERMANENTLY REMOVED FROM FATHER BY DEPENDENCY COURT.GOOD LUCK TO YOU.
